The former mayor will defend four charges of aggravated sexual assault and four charges of aggravated indecent assault that allegedly occurred against two women between 2003 and 2010.

The women, one aged in her 20s and one in her 40s, were under Cr Neville’s care in his role as a probation and parole officer.

A 19-day trial in Wagga earlier this year returned a hung jury after six-and-a-half hours of deliberations failed to deliver a verdict.

Judge Jennifer English commented that a deadlocked jury was common in “trials of this nature”.

There have been numerous delays in the court process since Cr Neville was arrested at his home in May 2010.

The trial was originally set down for Griffith but it was deemed appropriate to move the proceedings to Wagga.

It was listed to begin on March 5 this year but was postponed after the region’s flood crisis saw Wagga’s CBD evacuated for two days.

Proceedings began on March 12 but within two days the jury had been dismissed for unexplained reasons.

The full trial finally got under way two days later.

Since the failure of the first trial, the case has been through two “call overs” in Sydney District Court, where the

Director of Public Prosecutions had the option of abandoning the case.

The retrial is listed for Monday morning and is set down for 25 days.

Cr Neville was mayor of Griffith when he was arrested and remained in the role until he was ousted by John Dal Broi at last month’s election.
